New Regulations for Online Video Sharing

New Regulations for Online Video Sharing

The State Administration of Press, Publication, Radio, Film, and Television (SAPPRFT)–formed last year by the merger of SARFT and GAPP–publicly issued the following notice on January 20. Among its provisions is real name registration for all users uploading to video sharing sites.

SAPPRFT “Notice Concerning Next Step in Improving Management of Internet Dramas, Micro-Films and Other Online Audio-Visual Programming”

Online audio-visual programming service work units must establish primary responsibilities; check broadcasts; and produce and broadcast Internet dramas, micro-films, and other online audio-visual programming which are suitable for dissemination, embody the spirit of the times, enhance that which is true, good, and beautiful, and delight the people and the masses. Those engaged in the production and creation of Internet dramas, micro-films, and other online audio-visual programming should obtain a broadcast television program production license issued by the Radio, Film, and Television Authority, in accordance with the law.

Online audio-visual programming service work units must not broadcast Internet dramas, micro-films, and other online audio-visual programming which have not yet obtained a broadcast television program production license. Internet dramas, micro-films, and other online audio-visual programming produced and uploaded by individuals must fulfill the production responsibilities of the Internet audio-visual programming service work unit distributing the program.

Online audio-visual programming service work units may only distribute Internet dramas, micro-films, and other online audio-visual programming uploaded by individuals who have already verified their real identities and who comply with content management regulations. Do not distribute such programming uploaded by users who are not using their real names.

Local SAPPRFT administrative departments must strengthen the management of radio, film, and television program production; develop targeted training for the main producers of Internet dramas, micro-films, and other online audio-visual programming; reinforce the selection of themes and management of Internet dramas and micro-films; and ensure that the topics selected advance positive and healthy [ideas]. At the same time, guide the main content producers towards awareness of and commitment to the correct path by convening symposia, evaluating outstanding programs, and by practicing self-regulation and artistic critique.

Internet dramas, micro-films, and other online audio-visual programs must have records filed before being uploaded; after they have been broadcast online, they must be taken offline immediately if the masses report it or if SAPPRFT finds the content does not abide by relevant national regulations. If the aforementioned content violates relevant laws and regulations regarding radio, film, and television, the primary managing department may exact punishment in accordance with the “Regulations on Broadcasting and Television Administration” and “Provisions on Production, Operation, and Management of Broadcast and Television Programming.”
